Terms of Service

These Terms of Service ("Terms") govern your use of the e-Cities classifieds marketplace platform operated by HoopFrog Inc. ("we", "us", "our"). By accessing or using e-Cities, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our services, you confirm that you are at least 18 years of age and agree to comply with these Terms, our Privacy Policy, and all applicable laws. If you do not agree, you must not use e-Cities.

2. Your Account

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• One account per person. Creating multiple accounts may result in suspension.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Listings

• You are solely responsible for the accuracy and legality of your listings.
• Listings must not be misleading, fraudulent, or deceptive.
• All items listed must be legal to sell under Canadian federal and Alberta provincial law.
• Photos must accurately represent the item being sold and must not infringe on third-party intellectual property rights.
• We reserve the right to remove any listing at our sole discretion, without prior notice.
• Listings expire after 30 days unless renewed.

4. Prohibited Items

The following items and services are strictly prohibited on e-Cities:

• Firearms, ammunition, and weapons (including replicas)
• Illegal drugs and controlled substances
• Stolen property
• Counterfeit goods and fake identification
• Live animals (sale or trade)
• Human remains, body parts, or organs
• Hazardous materials (explosives, radioactive materials)
• Adult/sexual services
• Items that promote hate, violence, or discrimination
• Any item or service illegal under Canadian law

Posting prohibited items may result in immediate account termination and reporting to law enforcement.

5. Payments and Transactions

• e-Cities is a platform that connects buyers and sellers. We are not a party to transactions between users.
• All transactions are conducted directly between buyers and sellers at their own risk.
• We strongly recommend using secure payment methods such as Interac e-Transfer.
• e-Cities is not responsible for the quality, safety, or legality of items sold, the truth or accuracy of listings, or the ability of sellers to sell or buyers to pay.

6. User Conduct

You agree not to:

• Use e-Cities for any unlawful purpose.
• Harass, threaten, or abuse other users.
• Post spam, phishing links, or malicious content.
• Scrape, crawl, or use automated tools to access the platform without our written consent.
• Circumvent any security features or access restrictions.
• Impersonate another person or entity.

7. Disputes

Disputes between users should be resolved directly between the parties involved. e-Cities may, at its sole discretion, offer mediation support but is not obligated to do so. We are not liable for any disputes arising from transactions between users.

8. Limitation of Liability

To the fullest extent permitted by law:

• e-Cities is provided "as is" and "as available" without warranties of any kind.
• We do not guarantee uninterrupted, secure, or error-free operation of the platform.
• Our total liability for any claim arising from your use of e-Cities shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 CAD, whichever is greater.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.

9. Intellectual Property

The e-Cities name, logo, and platform design are the property of HoopFrog Inc. Users retain ownership of content they post but grant e-Cities a non-exclusive, royalty-free licence to display, distribute, and promote their listings on the platform.

10. Termination

• You may delete your account at any time through your account settings.
• We may suspend or terminate your account at any time for violation of these Terms, with or without notice.
• Upon termination, your listings will be removed and your personal data will be handled in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform. Your continued use of e-Cities after changes constitutes acceptance of the revised Terms.
